FMCSA’s Notice on Possible Elimination of DOT Application Is Moving Forward

In early February 2019, FMCSA sent its ‘advance notice of proposed rulemaking’ document concerning the future of the DOT employment application to the White House’s Office of Management & Budget (OMB) for review. OMB review is one of the final steps before a federal agency publishes a significant rulemaking notice. This notice will not eliminate the DOT application. FMCSA will explain its current thinking on the topic, and pose a number of questions to the industry on whether the Agency should move forward with a deregulatory action to eliminate the “application for employment” rule at 49 CFR 391.21.
